Vibrant Democracy, Dormant Parliament

“WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN, SOCIALIST, SECULAR, DEMOCRATIC REPUBLIC and to secure to all its citizens:

JUSTICE, social, economic and political;

LIBERTY of thought, expression, belief, faith and worship;

EQUALITY of status and of opportunity; and to promote among them all

FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;

IN OUR CONSTITUENT ASSEMBLY this 26th day of November, 1949, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.”

This landmark vows taken by us signifies the holy ideas enshrined in our Constitution as PREAMBLE, to rejuvenate its dignity and lost glory.

Constitution divides power between the legislature, executive and judiciary to keep the balance between Directive Principles of State Policy and Fundamental Rights. In the INDIAN REPUBLIC, all three organs are complementary to each other, but it is the legislature i.e PARLIAMENT which should have its heart.
It's designated roles for democracy are legislation-law of the land, ensuring accountability of government, discourse and debate on the issue that concern the nations and its citizens. and as ‘the guardian of the public purse’, its role in budgetary governance, include Budget approval, scrutiny of its implementation, and holding the government to account.
But even after 70 years, we have seen that diminished its stature rather than evolving and maturing.
Present day Parliament facing :

  • manipulated legislative procedure which includes vague interpretation of the bill's type (latest Aadhar bill), misuse of majority in the lower house since the number of MP in Lok Sabha is more than twice leads to inherent more weight-age  to Lok Sabha 
  • walkouts based on petty politics, some party for the just sake of creating the impediment in the working of the present government use to follow parochial methods like walkouts, refusal from voting, making disruption in the house
  • ruthless party whip questions the sovereignty and liberty of thoughts of the member as an individual
  • misused of parliamentary privileges by the narrow interpretation of the criticism of the parliamentary procedure,
  • nepotism, money-muscle power, loopholes in anti-defection law and other institutional constraints leads to snail's pace of legislation, partisan discussion, the inadequate time period for filtration of the bill which is emasculating our Parliament as an institution, which reminds me of Gandhi's warning against Parliamentary Democracy who emphasizes on "Self-Rule" and often called it sterile women and a prostitute”.

It is essential to recognize the complexity of this problem before we can find or design solutions. The answers lie, inter alia, electoral reforms in public funding of election, combined with political reforms that mandate accountability of elected representative and foster intra-party democracy that has been stifled not only by dynasties but also by oligarchies.
